Article (185)State’s Monopoly of the Armed Forces

The State monopolizes the constitution of security and armed forces. This should be by virtue of law and in service of public interest. It is prohibited for any person, party or group to constitute military or paramilitary groups.

Article (186)Admission in national army and police

It is prohibited to discriminate between candidates willing to adhere to armed and security forces. Specific conditions for cases that require particular qualifications, skills and capacities. It is prohibited for members of army and police to adhere to political parties.

The members of the judiciary are the judges and public prosecutors. Law sets out conditions for appointing and promoting them so to ensure selecting the best suited and the most capable and regulates their rights, duties and careers.

Article (187) The Army

The Army is an armed military force based on discipline and hierarchy and constituted, organize and structured according to law. It is obliged to observe full neutrality and is subject to the Civil Authority. It has no role in the peaceful alternation of power and does not interfere in political life. Necessary measures for this are stated by law. National service conditions and status are stated by a law.

Article (188) Missions of the Army

The Army ensures the duty of defending the nation, its independence, the unity and safety of its territory. It assists the security institutions according to law. It is prohibited for the Army to detract the constitutional order and the State’s institutions or to obstruct their activities or restrict rights and freedoms of citizens.

Police is a statutory body which is civil, technical, disciplinary, hierarchic and specialized. Its mission consists in fighting against crime, in ensuring public security, order, respect of law, protection of people’ rights, freedoms, security and properties. Members of police undergo a training on respect of human rights and means of prevention and discover of crimes.
